Alcove Terms of Service
1. Agreement
These terms govern use of the Alcove platform operated by Aphys LLC ("Aphys"). By creating an account or using Alcove, you agree to them. If you use Alcove for an organization, you agree on that organization's behalf.
2. Accounts and authorized users
Each organization designates administrators who create user accounts and assign roles. Users must provide accurate information and keep their login credentials confidential. The organization is responsible for activity under its accounts.
3. Organization responsibilities
Organizations decide who may access their data, what they record, and how they use Alcove's alerts. Organizations must comply with laws that apply to their records, including FERPA for student information.
4. Acceptable use
Do not use Alcove to store unlawful content, to send false alerts, to harass anyone, or to attempt to access another organization's data. Do not attempt to disrupt or reverse engineer the service.
5. Text message alerts and opt-in
Alcove users sign in and agree to become users of Alcove. Within Alcove, each user then chooses whether to receive text message alerts from Aphys. No text messages are sent unless the user has opted in. Alcove sends standardized building alerts and incident alerts. Message frequency varies. Message and data rates may apply.
To stop all Alcove text alerts, reply STOP. STOP removes you from building alerts and incident alerts. Reply HELP for help. Users may also opt out at any time inside Alcove or by emailing info@aphysllc.com. Text messages are delivered through Twilio. See our Privacy Policy for details.
6. Not an emergency service
Alcove is an information and notification tool. It does not replace 911 or other emergency services, and it cannot guarantee that a message will be delivered or read in time. Organizations must maintain their own emergency procedures.
7. Ownership of data
Each organization owns the records it enters into Alcove. Aphys receives only the rights needed to operate the service for that organization.
8. Export and termination
Organizations may export their data at any time, free of charge. On termination, organizations may export their data as described in the Privacy Policy. Aphys deletes the data ninety days after termination, except where law requires otherwise.
9. Availability
We work to keep Alcove available but do not guarantee uninterrupted service.
10. Disclaimer and limitation of liability
Alcove is provided "as is." To the extent permitted by law, Aphys is not liable for indirect or consequential damages.
11. Governing law
These terms are governed by the laws of the State of Minnesota. Disputes will be heard in Dakota County, Minnesota.
12. Changes
We may update these terms and will post the new version with an updated effective date.
